Costs of divorce and fixed fee divorce

Costs of divorce and fixed fee divorce

It is important that you understand the costs of divorce from the outset. Our family lawyers will be able to give you a clear estimate on the cost of carrying out the divorce if the matter is complex. They can also explain the fixed fee divorce cost we offer.

In order to be prepared for the costs you may incur it is important to bear in mind your circumstances once you have decided to divorce. One of you will be the petitioner (the person who initiated the divorce proceedings) and the other the respondent.

There are a number of key costs to take in to account when proceeding with a divorce. Divorce is a legal procedure and as such necessitates paperwork to be filed with the courts. The courts charge a fee of £340 (£300 payable when papers are filed and £40 to apply for the Decree Absolute at the end of the case (correct as of Jan 2010) to handle the paperwork. If you instruct us to complete the divorce for you there will be our fees on top of the Court charges.

Fixed Fee costs
We offer a fixed fee cost* for an undefended divorce. For a divorce with children, where the divorce is uncontested our fixed fee cost is £650 plus VAT. In addition to this you will need to pay the court charge and petition fee. If there are no children then an undefended divorce fixed fee is £500 + VAT.

In certain circumstance you may qualify for public funding. The cost structure is different so please talk to an advisor.

*our fixed fee cost only covers your representatives time on the case, you will still have to pay any other costs relating to the divorce including court charges and petition fees.
